Executive Order 14160 restricts birthright citizenship
Executive Order 14160, titled Protecting the Meaning and Value of American Citizenship, was signed January 20, 2025 and published in the Federal Register as document 2025-02007. It directed the federal government to restrict birthright citizenship for certain children born in the United States. The Supreme Court held the order unconstitutional under the Citizenship Clause of the Fourteenth Amendment in Trump v. Barbara, decided June 30, 2026.
Context
The order was one of 26 executive orders signed on January 20, 2025, per the Federal Register disposition list. It was litigated from the outset and was blocked before the Supreme Court ruled, so the restriction it described was never in force. The Supreme Court held that children born in the United States to parents unlawfully or temporarily present are citizens at birth under the Citizenship Clause of the Fourteenth Amendment, and affirmed the judgment against the order on certiorari before judgment to the First Circuit.
